The Volyn District Administrative Court drew attention to this.<\/p>\n<p dir=\"auto\">In support of such a conclusion of the court is the fact that the decision of the Cabinet of Ministers of Ukraine dated <strong>May 16, 2024 No. 560<\/strong> the Procedure for the draft of citizens for military service during mobilization in a special period was approved. This order regulates the issue of deferment from conscription for military service during mobilization, and item <strong>63<\/strong> it was determined that conscripts who applied to the district (city) <strong>TCC<\/strong> with an application for a postponement, are not sent for a medical examination to determine fitness for military service until the relevant commission makes a decision.<\/p>\n<p dir=\"auto\">The court established that <strong>TCC<\/strong>, as the authority responsible for deciding the issue of granting a postponement, after receiving the application and documents from the plaintiff, which confirm the grounds for granting a postponement, should have considered this issue without prior passing <strong>VLK<\/strong> and clarification of military registration data.<\/p>\n<p dir=\"auto\">The absence of a properly formalized decision to grant a deferment from conscription for military service during mobilization or a justified refusal to grant such a deferment indicates the illegal inaction of a person in authority.<\/p>\n<p dir=\"auto\"><strong>RESULT:<\/strong> the court made a decision on the partial satisfaction of the claim, recognizing inactivity <strong>TCC<\/strong> regarding the illegal non-consideration of the plaintiff&#039;s application for postponement, and obliged the defendant to reconsider this application.<\/p>","protected":false},"excerpt":{"rendered":"<p>Conscripts undergoing military training is not necessary and expedient in the case of the right to postponement \u2014 the Administrative Court.
